Nhs (Personal Medical Services Agreements) Regulations 2004
Welsh ministers have not exercised their power to develop regulations on pmS agreements and, at the time of the letter, there is currently no agreement on SMP in force in Wales. Section 44 of NHSWA 2006 provides that an LHB, under the conditions of the regulations adopted by the Welsh Ministers, provides for a general medical care contract with a doctor, two or more persons who engage in a partnership when the legal requirements of Section 44, paragraph 2, are met, or by a company limited by shares when the legal conditions of Section 44 paragraph 3 are completed. , to close. Section 206 of NHSWA 2006 and Section 5 of, and Schedule 1 to, the Interpretation Act 1978 define a `medical practitioner` as a fully registered person in the meaning of the Medical Act 1983 who holds a license to practice under that Act. Section 54 of NHSWA 2006 is for a LHB may recognize a committee formed for its area, and that of or more is representative of :a) any physician who provides initial medical services under a general medical services contract within the Committee and any physician who provides general ophthalmological services, and (b) any physician who provides first-line medical care in this area and who has indicated to the LHB that he wishes to be represented by the Committee. The approved committee is called the Local Medical Committee for the area for which it is formed. Welsh ministers can adopt rules requiring an LHB to consult each of them on such occasions and in the widely-required committee, and a committee has other functions prescribed by Welsh ministers. Regulation 27 of the National Health Services Contracts (Wales) Regulations 2004 provides for the duties of local medical committees. The 2004 regulations act as in Section 54 of NHSWA 2006.
Section 42 provides that an LHB may enter into a contract called a general medical services contract to provide primary medical services. The contract may make an agreed arrangement between the parties regarding the benefits to be provided, compensation under the contract and all other matters. Services to be provided under such a contract may include services other than primary health care and services that must be provided outside the LHB sector.
